Power of Judicial Review

Abstract

A citizen may not be so much critical of a bad law passed by the legislature than he is when he does not get any justice. Judiciary not only punishes the violators of law but also safeguards the citizens against the arbitrariness and authoritarianism of the state. The judiciary checks the executive and the legislature from the infringement of their (citizens) rights. In many countries, the ability of the judiciary to check the legislature is enhanced by the power of judicial review. This power empowers judiciary to declare any legislative and executive action as void if such act in its opinion violates the letter and spirit of the constitution of the land. Judicial review is the doctrine in democratic theory under which legislative and executive action is subject to the scrutiny of the judiciary.
