Enregistrement des naissances a l’état civil: Un droit pour l'enfant et un devoir pour les parents. Cas de la commune de Lubumbashi, Province du Haut-Katanga (RD Congo)

Abstract

The permanent growth of the population in the town of Lubumbashi following the example all modern cities of the RDC, constitutes a major problem of reliable statistical data as for the birth registration to the civil status.

Many parents do not register births, and many questions remain pending. According to the law n 9/001 of January 10, 2009 on the protection of the child in its article 14 stipulates: every child has rights to an identity from its birth. Without prejudice to the provisions of Articles 56 to 70 of the Family Code, the identity shall consist of name, place, date of birth, sex, parents names and nationality. 1. And in Article 16 adds: “Every child has the rights to be registered in the civil register within ninety days after birth, in accordance with the law. Registration is free of charge. 2. In approaching this subject in our research, we are fed with a sense of popularization of this law so that each parent knows that it is a duty to declare the birth of his child as soon as he is born. This will allow the child: Know your parents and have the chance to be raised by them, To have a name and a nationality, To be rights to inheritance, to identify the link of his birth, To enable vital statistics to have reliable statistical data on the birth rate, Obtain a passport or driver's license.

Given the benefits of this simple gesture that is beneficial to the child, each parent must be involved. The finding is bitter on the ground, Many parents are unaware of this act, and children are sacrificed, because if the period of 90 days provided for by law is exceeded, the law requires a suppletive judgment, and a payment of court costs in court for child and a fine for late declaration so that it is rehabilitated in its rights. On the basis of this analysis, we can signify that the registration of birth in civil status is a right for the child and a duty for the parents because this act is of paramount importance in the development of a nation.
