Politics on the backward classes reservation in Jammu and Kashmir

Abstract

Jammu and Kashmir has been one of the pioneering north Indian states to launch affirmative action for backward classes in 1956. The government notified two types of backwards–one for scholarship and another for employment reservation. The Supreme Court nullified the reservation policy in 1968 and directed of frame new reservation policy. In 1973, the Supreme Court found flaws even in the second reservation policy and asked for rectification before implementation. The third backward classes reservation policy was implemented in professional education in 1982 and in employment in 1994. In comparison to the national policy, the backward classes reservation policy had exceptions and aberrations. The paper attempts to explore and evaluate the norm of identification of backward classes, framing of the first, second and third backward classes reservation policy, examines the two-phase implementation of the third policy and compares it with the national policy. The study does an in- depth exploration and analysis of the policy evolved through a protracted process up to the dismissal of the democratic regime in June 2018, identifies addition of new categories for reservation and proposed changes in the policy without explanation and examination because the old policy is still applicable in J&K Union Territory and the proposed changes have not become applicable.
