Disciplinary and Dismissal Issues and Procedures in the European Work Environment: A Brief Review

Abstract

The paper has attempted to examine both disciplinary and grievance procedures in the United Kingdom and other major European economies. It has been found that there is a potentially wide range of procedural outcomes and these tend to provide the parties to the employment relationship with a constitution as well as being operational mechanisms. It has been found that different European countries follow specific procedures and some of these are required by laws whereas many others are the products of joint decision making between the employees’ representatives and management or the outcome of unilateral decisions by the management. This paper also attempts to understand the different fundamental practices and procedural requirements in different European nations, which render the disciplinary and dismissal decisions to be considered as fair or unfair. Finally, it can be concluded that with the growing involvement and adoption of procedures, most of the major European economies have witnessed positive culminations of fairness in the disciplinary and dismissal related decisions in recent times.
