Law to regulate educational institutions vis-à-vis right of the students to refund of fee

Abstract

To impart adequate education to its citizens is the sovereign function of the State. However, due to peculiar financial constraints, the State falls short in the discharge of this indispensable duty. Hence, we see, perforce, the advent and proliferation of private unaided educational institutions under selffinancing scheme on a huge scale presumably to supplement the efforts of State in this sphere. Plethora of authoritative pronouncements of the Hon'ble Supreme Court of India has accorded wide range of autonomy to such institutions in the matters of administration and management. At the same time, the control of the State over such institutions in certain matters like imparting of qualitative education, fee, transparency etc. has been retained. Of the late, it is seen that these institutes have turned themselves virtually into extortion centers fleecing the poor students on one pretext or other. The fee norms laid down by the respective State Fee Committees are flouted with impunity. On the other hand, most of these institutes miserably fail to provide even bare minimal facilities to the students in terms of qualified faculty and other essential infrastructure. However, needless to emphasize that these self-financing colleges not only provide umpteen opportunities for the students to pursue their studies in their interested professional courses but also render enormous job avenues to the people at large in the shape of teaching and nonteaching staff.
